Legal Separation

Legal Separation is an alternative to Divorce. Some couples choose to file for a legal separation (“separate maintenance”) instead of getting a divorce. This may be for religious, legal, or ethical reasons; holding out hope for reconciliation; or any other reason a person chooses.

While property can be divided and custody, parenting time/visitation, and child support set, the parties are still legally married. It does, however, have the added benefit of keeping insurance in place over a spouse who may not necessarily have affordable insurance coverage available to him or her, was a final divorce to take place.

WhitbeckBennett’s Oklahoma team can get a final Decree of Separate Maintenance in place for you, dividing property and debts or providing care and support for your children, while at the same time preserving other aspects of your marriage that you each find necessary without the desire for a full divorce.
